In 2023 and 2024, the Commonwealth passed numerous changes to existing laws and introduced new ones. Virginia Legal Update covers changes relating to continuing education requirements, license reciprocity, appraisal, common interest communities, leasing, settlement, and tax exemptions for disabled veterans. Also crucial to a licensee’s understanding is the National Flood Insurance Program, flood hazard area mapping, and how flooding issues can impact a real estate transaction. Case studies and examples help bring the content to life and help licensees apply ethics to their real estate practice.

This course is approved for one hour of continuing education for Virginia real estate licensees. This course covers legislation that passed in the 2023 General Assembly session that impact the real estate business including bills passed that are part of the Virginia REALTORS® legislative agenda. All laws were effective July 1, 2023. This means that any real estate sales contract ratified on or after July 1, 2023, must adhere to the new laws.

This course is designed to fulfill the broker management continuing education requirement.  It addresses the planning of a new brokerage business as well as its ongoing operation. The course reviews key provisions of the Code of Virginia and the Virginia Administrative Code that address the supervisory obligations of a Virginia broker related to brokerage office management, licensure, and the real estate activities of their associated licensees.

This course describes the responsibility that employing brokers have to supervise their affiliated licensees and unlicensed employees. Brokers must exercise reasonable and adequate supervision of their affiliated licensees as well as all transactions involving a real estate licensee.

Brokers establish policies, rules, and procedures in a written policy manual that outlines what the brokers expect of their salespeople, associate brokers, and office staff. The policy manual should cover basic topics such as brokerage relationships and other disclosures, prospecting, using social media, insurance, advertising, transaction paperwork, record retention, and commissions. Additionally, brokers must have a system for monitoring compliance with the policies and procedures adopted for the office.

Even though brokers supervise the activities of their licensees, occasionally problems do arise between buyers or sellers and their real estate agents during a transaction. Hopefully, the issue can be resolved quickly without a complaint being filed with the DC Real Estate Commission. The Commission has the right to investigate the actions of any broker, associate broker, or salesperson whose license or certificate was issued under the DC Real Estate License Law.

Licensees who follow the DC statutes and Commission Rules should be able to create a successful and rewarding for themselves. Remember, these are not suggestions.

The course contributes to the professional competence of brokers and reinforces their knowledge and skills in the real estate profession and is approved for 3 hours of continuing education.

This Property Management Survey course is a three-hour continuing education course that provides licensees with an overview of various aspects of property management within the District of Columbia. Special emphasis is placed on the District of Columbia’s laws, regulations, final rulings, etc. regarding licensure, exemptions, and the duties and fiduciary responsibilities of licensees involved in leasing or managing real estate (including freehold and non-freehold interests). The information presented in this course is useful not only for property managers, real estate brokers, salespersons, common interest managers, association boards, and community association managers but also for members of the general public. Upon the completion of this course, the successful participant will receive a certificate of completion.

The course reviews the most common regulations that both freehold and non-freehold property managers must follow regarding property interests within the District of Columbia. This survey includes local and federal laws and regulation, as well. Also, the course information clarifies the requirement that any property management activities done for others, whether the management is for freehold or non-freehold interests, conducted for a fee, can only be done by an individual (artificial or real) licensed by the District of Columbia Real Estate Commission (Commission). Several case studies are included throughout the course to assist the student in developing a better understanding of the property manager’s role in promoting and protecting the public trust while performing property management functions within the District of Columbia.

This course looks at the history of fair housing and examines in depth the most pertinent legislation in force today. The Fair Housing Act of 1968 was the first major legislation that applied to residential housing. The Fair Housing Amendments Act of 1988 broadened the coverage, increased the enforcement policies of the Act and stiffened the penalties invoked for violation of the Act. Specific advertising policies are investigated and illustrated. The procedure for filing a complaint of discrimination are studied in detail and there are lots of hints on how to stay clear of discriminatory practices in sales, rentals and financing of real estate.

The D/L Maryland L Principles of Real Estate Practice online course is designed to meet the three-hour continuing education curriculum requirements as set forth by the State of Maryland. The chapters cover topic areas such as escrow funds, common ownership communities, property management and landlord-tenant law, and advertising. The course mixes presentation of facts, concepts, math, key terms, and real-life examples to illustrate the topics being taught, as well as videos and quizzes for self-assessment. Each chapter includes a required quiz that students must pass before continuing to the next chapter. There is also a comprehensive final exam.

Chapter 1 covers the journey toward equity and fairness in housing opportunities through the passing of federal laws and US Supreme Court case rulings. Chapter 2 defines protected classes and exemptions under the federal Fair Housing Act. Chapter 3 focuses on prohibited acts and best practices for real estate licensees to ensure compliance with the Fair Housing Act. 

The most basic definition of disclosure is to reveal something that was hidden. In real estate, sellers are required to disclose property defects that are visible or hidden if there is a possibility that knowledge of the defect will have an impact on a potential buyer’s purchasing decision.

Completing the disclosure process as required by federal and state laws and regulations is imperative to the soundness of a signed purchase agreement and buyer satisfaction. This course will cover key information to ensure you are better able to fulfill an agent’s duty of disclosure for both seller and buyer clients.

In this course, Chapter 1 covers key provisions of the Americans with Disabilities Act with a specific focus on public accommodations for service animals. Chapter 3 will provide an overview of the process for filing a discriminatory housing complaint and review several complaints involving decisions about the allowance for animals in housing and public accommodations. Demographics refer to statically gathered information that characterizes a given population by distinctive criteria. For instance, demographic analysis may divide persons into groups based on age, income, gender, or religion. And persons in a defined demographic group tend to demonstrate similar characteristics, such as preferred methods of shopping or a bias toward buying products with certain features.

In this course, we focus on demographic groups of people called generation groups. In Chapter 1, you will learn about the label for generation groups based on birth year and life experiences. In Chapters 2 and 3, you will learn about generational-specific buying and selling trends and how to better identify and serve the individualized needs of group members. Specifically, Chapters 2 and 3 cover a detailed review of the following four topics based on current home buying trends to ensure agents have important tools for guiding different generation group members through the home buying process:

• Environmentally-friendly homes
• Accessory dwelling units
• Planned unit developments
• First-time home buyer preparedness

The deadline for all REALTORS® to complete the mandatory Code of Ethics course is 12/31/2024 and every three-year period following that deadline.
